1. Introduction
I Can Swim LLC ("I Can Swim," "we," "us," or "our") is an adaptive aquatics program serving children with special needs and their families in Turlock and Modesto, California. We operate the I Can Swim web application and website (collectively, the "Platform").
This Privacy Policy explains how we collect, use, store, share, and protect your personal information when you use our Platform. It also describes your rights under California law, including the California Consumer Privacy Act (CCPA), and how we comply with the Children's Online Privacy Protection Act (COPPA).
By creating an account or using the Platform, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Platform.
2. Who We Collect Information About
We collect information about:
Parents and legal guardians who create accounts on the Platform
Children ("swimmers") enrolled in or applying for our adaptive aquatics program
Instructors employed or contracted by I Can Swim
VMRC/CVRC coordinators and Regional Center staff who use our coordinator portal
Because our program serves children, including children under 13, all accounts are created and managed by parents or legal guardians. Children do not create accounts directly on our Platform.
3. Information We Collect
3.1 Account and Contact Information
Parent/guardian name, email address, and phone number
Account credentials (email and password, stored in encrypted form)
Communication preferences
3.2 Swimmer (Child) Information
Because we serve children with special needs, we collect detailed information necessary to provide safe and appropriate aquatic instruction, including:
Full name, date of birth, gender, height, and weight
Diagnosis and disability-related information
Medical conditions, allergies, seizure history, and other health information
Behavioral information including self-injurious behavior, aggressive behavior, elopement history, behavior plans, and restraint history
Mobility status (ambulatory/non-ambulatory) and toileting status
Communication type and other therapies
Swimming background, goals, strengths, and interests
Photos and videos taken during or submitted for lessons (subject to your photo/video release authorization)
This information is used solely to provide safe, individualized swim instruction and to coordinate with Regional Center funding agencies where applicable.
3.3 Enrollment and Legal Documents
Signed liability waiver, photo/video release, and cancellation policy agreement
Digital signature records and timestamps
Enrollment status and approval history
3.4 Scheduling and Booking Data
Session bookings, cancellations, and attendance records
Lesson progress notes and skill assessments
Regional Center Purchase Order (POS) numbers, authorization dates, and session usage for VMRC/CVRC-funded clients
3.5 Payment Information
For private-pay clients, we collect information necessary to process payments. Payment card data is processed by our third-party payment processor and is not stored on our servers.
3.6 Technical Information
IP address, browser type, and device information
Usage logs and session activity on the Platform
Cookies and similar tracking technologies (see Section 8)
4. How We Use Your Information
We use the information we collect to:
Create and manage parent and swimmer accounts
Schedule, confirm, and manage swim lesson bookings
Provide safe, individualized swim instruction tailored to each swimmer's needs
Track swimmer progress and communicate updates to parents
Process and manage VMRC/CVRC Purchase Orders and Regional Center funding authorizations
Send transactional emails including booking confirmations, reminders, progress updates, and invitation links
Send optional newsletters and program updates (with your consent)
Comply with legal obligations and respond to lawful requests
Improve our Platform and services
We do not use your information for targeted advertising. We do not sell your personal information.
5. Children's Privacy (COPPA)
We take the privacy of children very seriously. All accounts are created by and managed by parents or legal guardians. We do not knowingly collect personal information directly from children under 13.
We collect detailed information about children (swimmers) only with the explicit consent of their parent or legal guardian, provided during the enrollment process. Parents may review, update, or request deletion of their child's information at any time by contacting us at info@icanswim209.com.
If you believe we have inadvertently collected information from a child without parental consent, please contact us immediately and we will take steps to delete that information.
6. How We Share Your Information
6.1 Regional Center Agencies (VMRC/CVRC)
For swimmers funded through the Valley Mountain Regional Center (VMRC) or Central Valley Regional Center (CVRC), we share swimmer information, progress reports, and Purchase Order data with assigned coordinators and Regional Center staff as required to administer the funding and services.
6.2 Service Providers
We share information with trusted third-party vendors who help us operate the Platform, under confidentiality agreements. These include:
Supabase (database hosting and authentication)
Vercel (web hosting and deployment)
Resend (transactional email delivery)
TextMagic (SMS notifications)
Payment processor (payment handling)
Where applicable, we enter into Business Associate Agreements (BAAs) with vendors who may process protected health information.
6.3 Instructors
Swimmer information, including relevant medical and behavioral information, is accessible to I Can Swim instructors for the sole purpose of providing safe swim instruction.
6.4 Legal Requirements
We may disclose information if required by law, court order, or government authority, or if we believe disclosure is necessary to protect the safety of our users or the public.
6.5 We Do Not Sell Your Data
We do not sell, rent, or trade your personal information to any third party for marketing or commercial purposes.
7. California Privacy Rights (CCPA)
California residents have the following rights under the CCPA:
Right to Know: You may request information about the categories and specific pieces of personal information we have collected about you in the past 12 months.
Right to Delete: You may request that we delete your personal information, subject to certain exceptions (e.g., information necessary to complete a transaction or comply with a legal obligation).
Right to Correct: You may request that we correct inaccurate personal information.
Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.
Right to Opt Out of Sale: We do not sell personal information. No opt-out is required, but you may submit a request to confirm this at any time.

No method of electronic storage or transmission is 100% secure. While we take data security seriously, we cannot guarantee absolute security.
10. Data Retention
We retain personal information for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. When a family's account is closed, we will delete or anonymize personal information within a reasonable period, unless retention is required by law.
11. Third-Party Links
The Platform may contain links to third-party websites. We are not responsible for the privacy practices of those websites and encourage you to review their privacy policies.
12. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Platform and, where appropriate, by email. The date at the top of this policy reflects the most recent update.
